The agreement between
you and Cura.

By creating an account or using Cura, you agree to these Terms and to our Privacy Policy. Cura is operated by Cura Health (“we,” “us”). If you do not agree, do not use Cura.

This is the term that matters most. Cura is an educational tool. It helps you understand your own health data and ask better questions — but it is not a substitute for professional medical advice, diagnosis, or treatment, and using it does not create a doctor–patient relationship.

• ·Always consult a qualified healthcare provider before making any health decision, and never disregard professional advice because of something you read in Cura.
• ·Cura is not for emergencies. If you may be experiencing a medical emergency, call your local emergency number immediately.
• ·Cura’s outputs can be incomplete or wrong. You are responsible for how you act on them.

You must be at least 18 years old and able to form a binding contract to use Cura. By using Cura, you represent that you meet these requirements and that any data you provide is your own or that you are authorized to provide it.

You sign in with Apple or a one-time passcode sent to your email. You are responsible for keeping your sign-in method secure and for activity under your account. Notify us promptly of any unauthorized use.

Cura is offered as a paid subscription, processed by Stripe. By subscribing you authorize recurring charges to your payment method.

• ·Renewal. Your subscription renews automatically at the end of each billing period until you cancel.
• ·Cancellation. You can cancel anytime from your account; cancellation takes effect at the end of the current billing period, and you keep access until then.
• ·Refunds. Except where required by law, payments are non-refundable. Subscriptions purchased through the Apple App Store are governed by Apple’s billing and refund terms.
• ·Price changes. We will give you advance notice of any price change before it applies to you.

If you choose to order lab tests through Cura, those tests are performed by independent third-party labs and providers. We pass lab pricing through at cost — we do not mark up the price of tests. Your subscription is our only revenue stream. Third-party labs and providers operate under their own terms and are responsible for their services; you may need to meet their eligibility and consent requirements.

You own the health data and content you put into Cura. You grant us a limited license to process it solely to operate and improve the service for you, as described in our Privacy Policy. We do not sell your health data.

You agree not to:

• ·Use Cura to provide medical care to others, or upload data you are not authorized to share.
• ·Reverse engineer, scrape, overload, or interfere with the service or its security.
• ·Use Cura for any unlawful purpose.

Cura, including its software, design, and content (excluding your data), is owned by us and protected by intellectual property laws. We grant you a personal, non-transferable, revocable license to use Cura under these Terms.

Cura is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that Cura’s outputs are accurate, complete, or suitable for any medical decision.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any health decision made in reliance on Cura. Our total liability for any claim relating to Cura will not exceed the amount you paid us in the 12 months before the claim. Some jurisdictions do not allow these limits, so they may not fully apply to you.

You agree to indemnify and hold us harmless from claims arising out of your misuse of Cura or your violation of these Terms or applicable law.

You may stop using Cura and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the service. Provisions that by their nature should survive termination (e.g. disclaimers, limitation of liability) will survive.

We may update these Terms as Cura evolves. If we make material changes, we will notify you in the app or by email before they take effect. Continued use after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-laws rules. For any dispute not subject to arbitration under the section below, you and Cura agree to the exclusive jurisdiction of the state and federal courts located in Arizona, unless applicable law requires otherwise.

Please read this section carefully — it affects how disputes between you and Cura are resolved and limits your ability to bring a class action.

• ·Binding arbitration. Except as noted below, you and Cura agree to resolve any dispute relating to Cura or these Terms through final and binding individual arbitration, rather than in court.
• ·Class-action waiver. Disputes will be handled on an individual basis only. You and Cura waive the right to bring or participate in a class, collective, or representative action.
• ·Exceptions. Either party may bring a claim in small claims court, and either party may seek injunctive relief in court to protect its intellectual property.
• ·Opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@curahealth.io. Opting out does not affect any other part of these Terms.
